New York Auto Accident Cases

I. New York's No Fault Law
New York has a no-fault law that provides certain protections to people injured as the result of a vehicular accident. Under this law, every injured person is covered for medical and out of pocket expenses for up to $50,000 regardless of fault. No fault pays for hospital expenses, X-rays and doctor's bills and will provide some compensation for lost earnings.
An application for no fault benefits, however, must be filed within 30 days of the date of the accident. This short filing period means that an injured person must act immediately after an accident in order to protect his or her rights.

We also process our clients' bills and make sure they get all of the benefits to which they are entitled. We also will address any appeals or hearings if no fault benefits are denied or interrupted. II. Injuries to Drivers
Anyone who has driven a car knows that no matter how careful you are, accidents can happen. Accidents can happen for a variety of reasons, including driver inattention, excessive speed, failure to yield, roadway defects and countless others.
New York law requires a driver to submit a report of an accident called an MV104. We assist our clients in making out this report to make sure that it is accurate and consistent with the manner in which the accident took place.

III. Injuries to Passengers
Passengers are also covered under the No Fault law, have the same protections and same 30 day filing period as discussed above.
Passengers in multi-vehicle accidents must be protected from any conflicts which may exist between the drivers of the vehicles. For example, if you are a passenger in a car which is involved in an accident with three other vehicles, it may be necessary to sue all three drivers so that you are protected no matter whose fault the accident turns out to be. We make sure that the rights of our clients are fully protected.
